Two years after the deaths of 63 children in Gorakhpur’s BRD Medical College, a state government probe has absolved Dr Kafeel Khan of all charges against him as well as commended him for doing everything in his power to help save lives.
The deaths had taken place in August 2017 after an alleged shortage of oxygen in the government-run hospital. Khan, a paediatrician in the hospital, had been suspended soon after. He was jailed for nine months after a criminal case of medical negligence, corruption and dereliction of duty was filed against him.
The case had taken a political turn with the chief minister Adityanath blaming Khan for the deaths while denying that the deaths occurred due to a shortage of oxygen at the government hospital.
But an inquiry panel instituted by the state government to probe the child deaths has concluded Khan is not guilty of the charges brought against him. The inquiry panel, formed in August 2017, submitted its report to the state government five months ago on April 18, 2019. Scroll.in has accessed a copy of the report authored by Himanshu Kumar, principal secretary in the Uttar Pradesh government.

‘No evidence of medical negligence’

The report says that “no evidence” of medical negligence and corruption has been found against Kafeel Khan. The report establishes that Khan was neither in charge of the ward where the deaths had occurred nor did he have anything to do with the “storage, tendering, payments, orders, supply or arrangements” of liquid oxygen at all.
The report commends Khan for doing everything he could to save lives “given the seriousness of the situation in spite of being on leave”. The report states that he rushed to the hospital and made arrangements for a “jumbo oxygen cylinder” given the sudden shortage of liquid oxygen.

Although Khan was not involved in the liquid oxygen procurement process for the hospital, “due to his honest efforts, the hospital was able to procure on August 11 and August 12, 500 jumbo cylinders from different companies”, the report adds.
The investigation found no evidence that Khan held a private medical practice at the time of tragedy.
The report concludes that the charges against Khan of medical negligence and corruption are “baseless and inconsistent”.

Political back and forth

The state government in its public communication has not yet acknowledged the report. On September 16, the Uttar Pradesh chief minister repeated his claim in an interview to the Indian Expressthat there had been no oxygen shortage in the hospital and that Khan had done nothing to help that day. “It was drama we are supposed to believe,” said Adityanath on Khan’s efforts to procure liquid oxygen.

But the inquiry report refuted this claim. “Recently an RTI application accepted that on August 11 and August 12, 2017 for 54 hours there was a shortage of liquid oxygen at the BRD Medical College,” the report said.
Khan accused the government of suppressing the results of this report. “The report was filed in April yet the chief minister keeps on blaming me for the deaths,” said Khan.
“The report was submitted to the state government in April so why then does the chief minister continue to say these things?” he asked.
Two years later, the state government is yet to identify who is responsible for the deaths of 63 children. “I believe the real culprits of the completely man-made tragedy at BRD, Gorakhpur are those who received letters of dues from oxygen suppliers, but did not make the payment,” said Khan.

In the last 24 hours, three significant developments have happened relating to the honey-trap scandal, currently rocking Madhya Pradesh. The most important and sensational development is the disclosure that more than a dozen IAS officers are involved in the scandal. Top police sources indicated that soon the names of those IAS officers will be disclosed by the SIT, which has been entrusted the inquiry. The second important development relates to the change in the head of SIT. Initially, Srinivas Verma was appointed as the head of the SIT, but within 24 hours, for reasons known to the government, Sanjeev Shami, a senior IPS officer, was given the assignment. Shami is regarded as a tough and professionally sound officer. Immediately after his appointment, he visited Indore.
In the third development, 18-year-old Monica Yadav – who was arrested with five other accused in the high profile honey-trap case – has turned approver and will be the main witness, said SSP Ruchiwardhan Mishra on Wednesday.
The announcement came a day after Monica’s father filed an FIR charging the five accused with human trafficking. Apart from Monica, police had arrested Aarti Dayal, Shweta Swapnil Jain, Shweta Vijay Jain, Barkha Soni and a driver, Omprakash, following the complaint of IMC superintending engineer Harbhajan Singh. He had alleged that he was being blackmailed to pay Rs. 3 crore against an objectionable video shot by the accused.
Sources said police hopes to learn from Monica how Shweta carried out the operation — by making Monica a ‘pawn’ in the case. The accused have extorted crores of rupees from several persons, said sources.
The SIT took Monica to a secret location, where she was questioned for over four hours by ADG Sanjeev Shami and SSP Mishra, in the presence of other members. The next step now is to provide protection to Monica and her father, said sources.
The SIT left Indore late on Wednesday night with Monica to collect evidence from Aarti Dayal’s home in Bhopal. Monica has also given information on Aarti’s role in the honey-trap case during interrogation, said sources adding that she also mentioned a hard disk in which many videos are saved. Police are trying to look for the hard disk in Bhopal.
The SIT has not been able to track Abhishek, the accused booked with the five others in the trafficking case. A team has been sent to the state capital to track him down.
Meanwhile the SIT has come across a list of 13 IAS officers – who served at different points of time in fisheries, agriculture, culture, industries, urban administration, labour, forest, water resources, public relations and general administration departments – that the women kept say sources.
The ring handler had created a ‘hit list’ from pages of a government diary with ticks and codes scribbled against their names. Names of some officers were encircled and some marked ‘imp’ or “OK”. Some had ticks marked against their names. Police are trying to crack these signs and words used by the gang, said an official. How many of them got booked is still a matter of investigation, but police have recovered clips of a few officials from the women’s cell phones, said sources. Inspectors are facing a rather embarrassing time compiling lurid details and transcripts of the seized sex clips.
All honey-trapped officials who are identified in these video clips will be showcased, regardless of post or seniority, after a forensic analysis, said a senior IPS officer. Police have found that one of the IAS officers snared in the honey-trap had even changed his cadre.
Nearly 4,000 files containing screenshots of sex chats, videos of officers in compromising positions and video clips have so far been extracted from the laptops and mobile phones confiscated from the honey-trap ring.
Five more girls, who were allegedly used by the pan-India quid-pro-quo sex syndicate, have been identified. Some are said to be teenagers. SIT is yet to decide on a line of action on these girls but sources say they are investigating the possibility that some of them may be minors.
CID on Wednesday registered a case of human trafficking against three of the honey-trap suspects on the basis of a complaint lodged by the father of the youngest accused, 18 years old. She was arrested on the basis of an extortion complaint by Indore Municipal Corporation engineer Harbhajan Singh and is in police custody. After being suspended by IMC Singh is in shock. “He was annoyed by the daily demands of money from these girls. He only wanted to get rid of them with a formal complaint” said a police officer. Many believe that he became the scapegoat of a senior bureaucrat who was himself honey-trapped

Average wealth of an MLA in India has swollen more than ten times from USD 1.3 million in the year 2015 to a ₹13.6 million in 2018, founder of the Association for Democratic Reforms said, Prof Jagdeep Chhokar said in New Delhi on Wednesday.
Professor Chhokar said that for an Indian MP, the average wealth in the year 2004 had stood at USD 280,639. However, the figure has grown to USD 2.9 million in the year 2019. Chhokar was replying to a query on the wealth of MPs and MLAs in India at a time when the country is going through a tough economic situation at a function held to commemorate 20 years of ADR, a non-governmental organisation that works in the field of electoral and political reforms in the country.
The function was held at the Foreign Correspondents Club of South Asia. As per ADR figures, the total wealth of all MPs in India stood at USD 144 million in the year 2004 and has now increased to USD 1.57 billion. Similarly, the combined wealth of all MLAs in the country that stood at USD 164.6 million in the year 2015 has now increased to USD 2.13 billion.
Replying to a query by IANS, Professor Chhokar said the organisation had been formed with the combined effort of 11 volunteers in the year 1999.
"These included eight IIM professors, two alumni of the IIM and one professor of the National Institute of Design. It was formed after we filed a PIL seeking implementation of the 170th Law Commission Report," said Chhokar.

Elaborating on the journey of the ADR over the past 20 years, Professor Chhokar said that his PIL demanding implementation of a 2014 order of the Central Information Commission that political parties are public authorities and hence need to be covered under the ambit of RTI is still pending in the Supreme Court.
"The government of India has submitted a counter-affidavit to the PIL asserting that political parties should not be brought under the RTI ambit. Our case on electoral bonds is also pending in the Supreme Court," he said.
The mandate upon candidates of all political parties to submit separate affidavits pertaining to their wealth and criminal background at the time of filing nominations for elections, considered to be one of the landmark steps in the electoral history of India, has been made possible largely due to the efforts of ADR.
"If we look at the countries bordering India, democracy is nowhere as successful as in our country. India is the only nation, from amongst all countries that got freedom from colonial rule in the 40s and 50s, to have an uninterrupted run of democracy. Also, for the past 20 years ADR has continued to exist, despite vehemently criticising all political parties, which is a tribute to the democratic traditions of India," said Chhokar
